Decision Making Capacity
Capacity assessments may be required when there are reasons to believe that an adult is not able to make his or her own decisions. Conversely, if an adult has been determined to lack capacity, a capacity assessment may be indicated in the case that the individual believes he or she has regained the ability to make his or her own decisions.
Testamentary Capacity Assessments
Testamentary capacity encompasses the capability of a person to create a last will and testament. Testamentary capacity assessments may be indicated In will disputes, if the there is an indication that creator of will (testator) did not have capacity to create a will at the time the will was executed. Testamentary capacity assessments may also be undertaken proactively to determine if a testator has capacity at the time that they are creating the will. This may prevent unwanted disputes of the will after the time of the testators passing.
